Online Safety legislation will potentially jail or fine bullies

After overcoming its final parliamentary hurdle in the House of Lords, the Online Safety Bill is set to become law, marking the culmination of years of effort and delay. This landmark legislation is designed to establish comprehensive regulations for online content, with a primary focus on safeguarding users, particularly children. The responsibility is squarely placed on social media companies to shield individuals from various forms of harm, such as abusive messages, bullying, and explicit content.

The genesis of this initiative dates back to a white paper in 2019, but its journey to becoming law has been arduous and fraught with challenges, including contentious debates over the principles of free speech and privacy. Michelle Donelan, the Technology Secretary, emphasized the transformative nature of the Online Safety Bill, stating, “This government is taking a monumental step towards making the UK the safest digital environment worldwide.”

Under the provisions of the bill, social media platforms will be obligated to promptly remove illegal content or prevent its dissemination, including materials promoting self-harm. Additionally, the legislation targets a wide range of illegal activities online, such as drug and weapon sales, incitement of terrorism, sexual exploitation, hate speech, scams, and revenge pornography.

The enforcement of these regulations will largely fall under the jurisdiction of the communications regulator, Ofcom. Social media executives failing to comply with the new rules could face substantial fines or even imprisonment as part of a rigorous crackdown.

Furthermore, the bill extends its protective ambit to shield children from potentially harmful but not illegal content, including materials related to eating disorders and alleged incidents of bullying.

Within the Tory Party, there have been concerns raised about the bill’s scope, with some fearing that it may unduly infringe upon online free speech, making it a topic of contentious debate.
