In the realm of journalism, controversy often arises from the pursuit of truth, raising ethical concerns and challenging societal norms. On October 16, 2009, a piece penned by Jan Moir in the Daily Mail generated significant controversy. The article disputed the naturalness of the death of Stephen Gately, a 33-year-old man, asserting that healthy individuals of his age don’t simply pass away in their sleep on a couch without reason. Moir insinuated that Gately’s demise was connected to drugs and a risky lifestyle.

Moir’s article sparked an immediate uproar, prompting more than 25,000 complaints to flood the Press Complaints Commission (PCC) that day. This influx of grievances caused the PCC’s website to crash for several hours. Responding to the article, Derren Brown and Stephen Fry led an online campaign against the Daily Mail and Jan Moir, utilising Twitter as their platform. Additionally, a Facebook page emerged, encouraging followers to voice their concerns to the brands that advertised alongside the contentious article.

Stephen Fry expressed his disgust, stating, “I gather a repulsive nobody writing in a paper no one of any decency would be seen dead with has written something loathsome and inhumane.” Derren Brown reflected that if Gately’s passing could prompt accountability for this kind of sensationalist journalism, it would stand as a tribute. Writer Graham Linehan, known for his work on shows like Father Ted and The IT Crowd, called for a complete boycott of the Daily Mail and urged companies to consider their association with it.

The backlash even led to the exposure of companies advertising next to Moir’s article, shared on a Facebook page named “The Daily Mail should retract Jan Moir’s hateful, homophobic article.” Amidst the controversy, false rumors circulated on Twitter, including an erroneous claim that the Daily Mail had reported Gately’s partner as his murderer.

The situation escalated to the point where retailer Marks & Spencer asked the newspaper to remove their advertisement from proximity to the article due to their commitment against discrimination. Nestlé also distanced itself from the article, stating that Moir’s words contradicted their values of respect and tolerance. The Nestlé brand Nescafé had been featured alongside the article.

Subsequently, the Daily Mail removed all advertising from the online version of the article, although their attempt to modify the original headline only further fuelled public anger. Moir defended herself by labeling the online backlash as a “heavily orchestrated internet campaign,” denying any homophobic or bigoted undertones in her article.

Commentators like The Guardian’s Charlie Brooker and Caitlin Moran of The Times denounced Moir’s article as hateful and vile. The editor of Attitude magazine questioned the homophobia apparent in Moir’s linking of Gately’s death with the suicide of Matt Lucas’s former partner. The PCC received complaints from Gately’s family, but they clarified that their role was primarily concerned with accuracy and intrusion, not offensiveness.

In Ireland, former Taoiseach Bertie Ahern criticised the sensationalist coverage from some British papers, while a radio station owner urged people to express their disagreement with the Mail’s coverage. Scotland Yard also received a complaint. Gately’s record company voiced their concern to the PCC, but the commission did not uphold the complaint, determining that while the article may have caused offense, there wasn’t sufficient evidence to show it breached the law. Tony Connell, a lawyer, explained that while many found the article offensive, its publication wasn’t deemed unlawful based on the principles of freedom of expression.
