TWO WEYMOUTH MEN GIVEN CRIMINAL BEHAVIOUR ORDERS

Two men have been banned from entering Weymouth seafront after causing prolonged intimidation and anti-social behaviour to the public.

 David Frederick Cant, 43, was issued with a Criminal Behaviour Order by Weymouth Magistrates’ Court, which started on Thursday 29 October 2015 and will last for five years.

The order was issued on the back of public order act offences where he used threatening, abusive or insulting words or behaviour on a businessman on Weymouth beach. He has also been convicted of a number of theft and drug offences.

Cant was sentenced to 12 weeks’ in prison and is due to be released on licence this week.

The Criminal Behaviour Order for David Cant states the following:

  • Not to act in or incite others to behave in an anti-social manner, that is to say, a manner that causes or is likely to cause harassment, alarm or distress to any persons within the commission of Dorset
  • Not to use or incite others to use threatening, intimidating, insulting or abusive words or behaviour in any place to which the public has access in the commission area of Dorset
  • Must not be together in any public place with Nigel Treadwell, Ian Jess Heatherington and two other men who cannot be named for legal reasons
  • Not to be drunk in any public place in Dorset
  • Not to enter the commission area of Portland
  • Not to enter the commission area of The Esplanade Weymouth from the Sea View Restaurant (formally known as the Pier Bandstand) to the pleasure pier behind the Weymouth Pavilion. The area known as Jubilee Business Park and Weymouth Train Station
  • Must engage with Exeter Drug Project (EDP) at least once a week until discharged by EDP

Ian Jess Heatherington, 46, has been banned from entering Weymouth seafront for the next three years after being convicted of making racially abusive comments toward members of the public.

He was issued with the Criminal Behaviour Order by Bournemouth Crown Court on 17 July 2015 after being sentenced to eight months imprisonment at the same court on 19 June 2015. He was released on licence in October 2015.

The court heard that Heatherington made racially abusive comments toward members of the public on Weymouth Esplanade on Saturday 6 September 2014. He was charged with causing racially aggravated fear or provocation of violence.

The order states that Ian Heatherington must not:

  • Act or incite others to behave in an anti-social manner, that is to say a manner that causes harassment, alarm or distress to any person in Dorset
  • Use or incite others to use threatening, intimidating, insulting or abusive words or behaviour in any place to which the public has access in Dorset
  • Enter The Esplanade, Weymouth from the Sea View Restaurant to the Pleasure Pier behind Weymouth Pavilion except between midnight and 6am from 1 November and 31 December each year
  • Be drunk in any public place in Dorset

And on 2 October 2016, Nigel Treadwell – aged 37 and from Weymouth – was issued with a five-year Criminal Behaviour Order which also banned him from Weymouth seafront.

Dorset Police worked in conjunction with the Community Safety Team at Weymouth & Portland Borough Council to bring the applications to the court.

Inspector Pete Browning, of Weymouth police, said: “David Cant and Ian Heatherington have caused misery for many in Weymouth over the years with their anti-social behaviour and persistent street drinking.

“This court order shows that we will deal with offenders such as Cant and Heatherington robustly and that this kind of behaviour will not be tolerated.

“Dorset Police is working hard to resolve the street drinking and associated crimes such as anti-social behaviour in Weymouth town centre.

“We work alongside the local authorities and the local community to ensure any concerns they may have are addressed and dealt with.

“This is the fifth Criminal Behaviour Order that has been issued to individuals in Weymouth town centre to combat street drinkers in Melcombe Regis and Weymouth.

“We will continue to work closely with Weymouth & Portland Borough Council, Shopwatch and Pubwatch to make Weymouth a safer family-orientated place to live and visit.”

Weymouth & Portland Borough Council Community Safety Brief holder Cllr Francis Drake said: “Our Community Safety Team worked with Dorset Police in a successful partnership to bring these cases to court.

“The team helped by attending a number of multi-agency meetings, collating statements and putting together a prosecution file.

“Our work on this case is just a small part of the work the borough council is doing to help combat problems with street drinking in Weymouth. 

“The borough council’s Community Safety Team will work with and assist Dorset Police wherever they can to help fight crime in the area.”
